Introduction

VISEKAI STUDIOS LLC ("we," "our," or "us") operates the VISEKAI application for Apple Vision Pro. This Privacy Policy explains how we collect, use, store, and protect your information when you use our app.

This Privacy Policy is part of our Terms of Service. By using VISEKAI, you agree to both documents. We are based in the United States and your data is processed in the United States.

Information We Collect

Account & Identity Data

When you first launch VISEKAI, we create an anonymous account using your device's vendor identifier. This allows us to associate your data across sessions without requiring personal information. If you choose to link your account, we also collect:

• Device Identifier: A vendor-specific device ID generated by the operating system, used to create your anonymous account.
• Sign in with Apple: If you link your Apple account, we receive an identity token from Apple. We do not receive your name or email address through this process — only a unique account identifier.

Gameplay Data

We collect gameplay data to power leaderboards, track your progress, and unlock in-game rewards:

• Scores & Progress: Game scores, highest round reached, total games played, and lifetime score.
• Aura Statistics: Which aura colors you consume and how many, broken down by color category.
• Guide Activity: Which tutorial and guide pages you have viewed.
• Leaderboard Entries: When you submit a score, we store your score along with your active spell configuration (hand gesture settings and aura palette) so other players can view top loadouts.

Configuration Data

To sync your settings across sessions, we store:

• Hand Gesture Configurations: Your custom spell-casting gesture settings for both hands.
• Aura Palette: Your unlocked and selected aura colors.
• Saved Presets: Up to 10 named hand configuration presets you create.

This data syncs automatically to our servers so your configuration is preserved if you reinstall the app or link a new device.

Sensor Data

• Hand Tracking: Processed entirely on your device in real time to enable spell-casting gameplay. Hand position and gesture data is never transmitted to our servers. This data represents skeletal joint positions used for gameplay input — we do not use hand tracking to identify or authenticate you, and it is not used as biometric data. No hand-tracking data is stored, transmitted, or used beyond the current gameplay session.
• Spatial Sensing: Scene reconstruction and plane detection data is processed on-device to let spells and creatures interact with your physical space. This data is never transmitted to our servers.

Crash Reports

If you opt in to share diagnostics with app developers through your device settings, we may receive anonymized crash reports from Apple to help improve the app.

Information We Do Not Collect

We do not collect:

• Your name, email address, phone number, or physical address
• Location data
• Photos, contacts, or data from other apps
• Camera or microphone recordings
• Payment or financial information (the app has no in-app purchases)

How We Use Your Information

• Account management: To create and maintain your anonymous account and link optional sign-in methods.
• Gameplay: To track scores, progress, and statistics that power leaderboards and unlock in-game rewards (such as cosmetic hats).
• Configuration sync: To preserve your hand gesture settings, aura palette, and presets across sessions and devices.
• Leaderboards: To display rankings and allow players to view the spell configurations of top-scoring players.
• App improvement: To understand gameplay patterns and improve the experience.

Lawful Basis for Processing (GDPR)

If you are located in the European Economic Area (EEA) or the United Kingdom, we process your personal data on the following legal bases:

• Contract performance: Processing your account, gameplay, and configuration data is necessary to provide the VISEKAI service you have chosen to use.
• Legitimate interests: We analyze anonymized gameplay patterns to improve app quality and stability, balanced against your privacy rights.

Data Storage and Security

Your data is stored in two places:

• On your device: A local file stores your full app state including identity, settings, statistics, and configurations.
• On our servers: Your account data, gameplay statistics, leaderboard entries, and configuration data are stored on a server located in New York, United States, operated by VISEKAI STUDIOS LLC via DigitalOcean. All communication between the app and our servers uses HTTPS encryption in transit. Access to your data is authenticated via a secure token issued at account creation.

Data Shared with Other Users

When you submit a leaderboard score, the following is visible to other VISEKAI players:

• Your score and rank
• Your active spell configuration (hand gesture settings and aura colors)

Your device ID, user ID, and account linkage information are never displayed to other players.

Third-Party Services

• Sign in with Apple: Used for optional account linking. Governed by Apple's Privacy Policy.

We do not use any third-party analytics, advertising, or tracking services.

Data Retention

• Account & gameplay data: Retained for as long as your account exists. When you delete your account (via the app or by contacting us), all server-side data is permanently deleted within 30 days.
• Leaderboard entries: Retained for as long as your account exists. Deleted when your account is deleted.
• Server backups: Database backups are retained for 7 days, then automatically purged.
• Local data: Deleted when you uninstall the app.

Your Rights

Depending on your location, you may have the following rights regarding your personal data:

All Users

• Access the data we hold about your account
• Delete your account and all associated server-side data (also available directly in the app under Settings)
• Unlink your Sign in with Apple account at any time from within the app

EEA / UK Residents (GDPR)

• Right to access: Request a copy of your personal data.
• Right to rectification: Request correction of inaccurate data.
• Right to erasure: Request deletion of your data.
• Right to restriction: Request that we limit processing of your data.
• Right to data portability: Request your data in a machine-readable format.
• Right to object: Object to processing based on legitimate interests.

California Residents (CCPA/CPRA)

• Right to know: Request disclosure of the categories and specific pieces of personal information we have collected.
• Right to delete: Request deletion of your personal information.
• Right to opt-out of sale: We do not sell or share your personal information for cross-context behavioral advertising. No opt-out is necessary.
• Right to non-discrimination: We will not discriminate against you for exercising your privacy rights.

"Do Not Sell or Share My Personal Information": VISEKAI does not sell your personal information, nor do we share it with third parties for cross-context behavioral advertising. We have never sold user data and have no plans to do so.

To exercise any of these rights, contact us at contact@visekai.app. We will respond to verifiable requests within 30 days (or 45 days if an extension is needed, with notice).

Children's Privacy

VISEKAI is not directed at children under 13. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us so we can delete it.

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Last updated" date.
