Agreement to Terms
By downloading, installing, or using VISEKAI ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app. These Terms are a legal agreement between you and VISEKAI STUDIOS LLC ("we," "our," or "us").
Your use of VISEKAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Eligibility
You must be at least 13 years old to use VISEKAI. By using the app, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Your Account
When you first launch VISEKAI, an anonymous account is created automatically using your device's vendor identifier. You may optionally link your account using Sign in with Apple for account recovery across devices.
You are responsible for maintaining the security of your device and account credentials. We are not liable for any loss or damage resulting from unauthorized access to your account.
Acceptable Use
You agree not to:
- Manipulate scores, exploit bugs, or use external tools to gain unfair advantages on leaderboards
- Submit fraudulent or artificially inflated leaderboard entries
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
- Interfere with or disrupt the app's servers, networks, or infrastructure
- Attempt to gain unauthorized access to any part of the app or its systems
- Use the app for any unlawful purpose or in violation of any applicable laws
Leaderboards
When you submit a score to the leaderboard, your score and active spell configuration (hand gesture settings and aura colors) become visible to all other VISEKAI players. Your device identifier and account information are never displayed to other players.
We reserve the right to remove any leaderboard entries that we determine, in our sole discretion, were achieved through cheating, exploitation, or violation of these Terms. We may also reset leaderboards at any time for maintenance or balancing purposes.
Cloud Sync
VISEKAI automatically syncs your configuration data (hand gesture settings, aura palette, and saved presets) to our servers. This data is associated with your account and is used solely to preserve your settings across sessions and devices. We are not responsible for data loss due to service interruptions or technical failures.
Intellectual Property
VISEKAI and all its content, features, visual assets, and functionality are owned by VISEKAI STUDIOS LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works based on the app without our prior written consent.
Account Termination
We may suspend or terminate your account at our sole discretion if we reasonably believe you have violated these Terms. Upon termination, your right to use the app ceases immediately.
You may delete your account at any time through the app's settings. Account deletion permanently removes all your server-side data as described in our Privacy Policy.
Disclaimer of Warranties
VISEKAI is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or free of harmful components.
Limitation of Liability
To the fullest extent permitted by applicable law, VISEKAI STUDIOS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill, arising from or related to your use of or inability to use the app, regardless of the theory of liability.
In no event shall our total aggregate liability exceed the amount you paid for the app, if any.
Indemnification
You agree to indemnify, defend, and hold harmless VISEKAI STUDIOS LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the app.
Changes to These Terms
We may update these Terms from time to time. We will notify you of changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of VISEKAI after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the app shall be subject to the exclusive jurisdiction of the courts located in the Commonwealth of Massachusetts.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
